This privacy policy applies to the Whispers mobile application as well as to the websites, services and features associated with it (hereinafter, together, the "Application").
This privacy policy describes how the Whispers application (hereinafter "We", "Our" or "Whispers") collects, uses, stores and protects your personal data when you use our application. Whispers allows you to discover and get in touch with people located nearby, according to three connection modes (Active, Blind Date, Shadow). We are committed to respecting your privacy and to protecting your personal data in accordance with the European Union General Data Protection Regulation (GDPR) and with French Law No. 78-17 of 6 January 1978, as amended, on information technology, data files and civil liberties.
1. Data controller
The Whispers Application is published and operated by Whispers (hereinafter "Whispers", "we"), the controller of the personal data described in this policy.
Whispers is not under a legal obligation to appoint a data protection officer (DPO) within the meaning of Article 37 of the GDPR in view of its current activity. Any question relating to the protection of your data may be addressed to the contact point indicated in Article 15 below. Whispers will, where applicable, appoint a DPO should the legal conditions come to require it.
2. Data we collect
We collect the following categories of data:
  • Identification data: First name, email address or telephone number, date of birth, profile photo.
  • Location data: Your approximate geographic position, in order to connect you with other users nearby. In accordance with the recommendations of the Commission nationale de l'informatique et des libertés (CNIL), we never share your exact position with other users, we allow you to control your visibility (Active, Blind Date or Shadow modes), to limit this access to active use of the Application, and to withdraw this authorisation at any time from your device settings.
  • Usage data: Information about the way you use our application, including connection requests sent or received, messages exchanged with other users, and the connection mode chosen.
  • Payment data: We do not collect or store your complete bank details: these are processed directly by the distribution platform used (Apple App Store or Google Play), as part of your subscription, where applicable.
  • Technical data: Device type, operating system, technical or advertising identifiers, IP address and connection data, collected automatically for security purposes and for the proper functioning of the Application.
  • Content you share: Photographs taken with the camera or selected from your device's library, as well as the messages you exchange with other users within the Application.
3. Purpose chains and examples of use
The purpose chains describe how the data will be used, taking into account the different features of the application. Each purpose chain is accompanied by a concrete example of the use of the data. These examples show how the Whispers application uses users' data to offer relevant proximity connections, while respecting their privacy and providing them with personalised options.
Making yourself visible to people nearby (Active mode)
Purpose: To allow the user to be visible and to connect with other users located nearby.
Use of the data: The application uses your approximate position and your profile to make you visible to nearby users who have activated a compatible visibility mode.
Example: When a user activates Active mode, they appear in the list of nearby people that other users can view.
Remaining anonymous (Blind Date mode) or browsing privately (Shadow mode)
Purpose: To allow the user to discover nearby connections without revealing their identity (Blind Date) or to browse the Application without being visible to other users (Shadow).
Use of the data: The application uses your approximate position to identify potential connections nearby, without disclosing your identity or your visibility, depending on the mode chosen.
Example: A user in Shadow mode can view nearby profiles without themselves appearing in the search results of other users.
Sending a connection request and exchanging messages
Purpose: To allow two users to get in touch and to exchange messages within the Application.
Use of the data: The application collects and stores connection requests as well as the content of the messages exchanged, so as to allow you to access them and to reply to them.
Example: When a user accepts a connection request, a conversation opens between the two users concerned.
Use of the camera and of the photo library
Purpose: To allow users to add photographs to their profile or to share them in a conversation.
Use of the data: The application will request access to the camera and to the photo library in order to allow images to be uploaded and shared.
Example: When a user updates their profile photo, the application offers them the choice of taking it directly or selecting it from their library.
These examples are provided for illustrative purposes, in accordance with the transparency best practices recommended by the CNIL; they are not exhaustive and may evolve together with the features of the Application.
4. Purposes of the data processing
We use your personal data for the following purposes:
  • Providing our services: To allow you to discover people nearby, to send and receive connection requests, and to exchange messages.
  • Improving our application: To analyse the use of the application and improve our services.
  • Communicating with you: To send you notifications, updates and information concerning your account.
  • Security: To protect our users and prevent fraud or abusive behaviour.
  • Personalisation and suggestions: To offer you relevant connections nearby, where applicable with the help of automated suggestion tools (see Article 6 below).
5. Legal basis for the processing
The table below specifies, for each category of data, the legal basis on which its processing is founded, in accordance with Article 6 of the GDPR:
  • Identification and account data: performance of the contract (our terms of use).
  • Location data: consent; or performance of the contract where the provision of the proximity matching feature makes it strictly necessary.
  • Usage data and technical data: legitimate interest (security, fraud prevention, improvement of the service).
  • Payment data: performance of the contract and compliance with our legal obligations, in particular accounting and tax obligations.
  • Content you share (photos, messages): performance of the contract, or consent for optional profile photos.
  • Communications for commercial prospecting purposes, where applicable: consent, which may be revoked at any time.
You may withdraw your consent at any time, without this affecting the lawfulness of the processing based on consent carried out before that withdrawal, by contacting us or by changing the settings of your device.
6. Artificial intelligence and automated decision-making
Whispers may use automated suggestion tools, for example to recommend nearby connections to you based on your preferences and your approximate location, as well as automated filtering systems to detect inappropriate content or behaviour. These tools constitute decision support and do not, to date, entail any decision producing legal effects or significantly affecting you within the meaning of Article 22 of the GDPR: you retain control over the final choice of any connection.
In accordance with Article 50 of Regulation (EU) 2024/1689 on artificial intelligence ("AI Act"), applicable to these transparency obligations from 2 August 2026, when you interact with an artificial intelligence system within the Application, we inform you of this clearly, except where it is obvious from the context of use.
If Whispers were to implement fully automated processing producing legal effects concerning you, you will have the right to obtain human intervention, to express your point of view and to contest the decision, in accordance with Article 22 of the GDPR.
7. Sharing of your data
We share your personal data with third parties only in the following cases:
  • Other users: The information in your profile (first name, photo, approximate position) is visible to other users nearby, according to the connection mode you have chosen.
  • Technical providers: hosting, development tools and, where applicable, providers of artificial intelligence solutions used for certain features of the application.
  • Distribution platforms: Apple (App Store) and Google (Google Play), strictly to the extent necessary for making the Application available, for its operation and for the billing of its subscriptions.
  • Legal obligations: We may disclose your data if the law requires it or in order to protect our rights and those of our users.
We do not sell your personal data to third parties and do not share it for data brokerage purposes or for advertising targeting by third parties without your explicit consent.
8. International data transfers
Some of our providers (hosting, development tools, artificial intelligence, Apple and Google platforms) may be established outside the European Union, in particular in the United States. Where this is the case, these transfers are governed, depending on the case, by an adequacy decision of the European Commission (in particular the EU-United States data protection framework, or Data Privacy Framework) or by standard contractual clauses approved by the European Commission, together with appropriate supplementary measures.

9. Cookies, trackers and software development kits (SDKs)
The Application may use cookies, advertising identifiers or third-party software development kits (SDKs) for the purposes of audience measurement, security or, where applicable, advertising personalisation.
Trackers strictly necessary for the functioning of the Application do not require your consent. Non-essential trackers (non-anonymised audience measurement, targeted advertising) are activated only after obtaining your free, specific and informed consent, which you may withdraw at any time in the settings of the Application or of your device, in accordance with the recommendations of the CNIL. A premium subscription without advertising is offered to users who wish to have one (see our Terms of Use).
Advertising mediation: We use the advertising mediation platform Appodeal, which itself calls upon a set of partner advertising networks (third-party SDKs). In this context, Appodeal and its partners may collect your IP address, your advertising identifier (IDFA on iOS, GAID on Android) and other technical identifiers, in order to serve, measure and, subject to your consent, personalise the advertisements displayed in the Application. 10. Data retention period
We will retain your personal data only for as long as necessary to achieve the purposes for which it was collected, including legal, accounting or reporting requirements.
By way of indication: account data is retained for the entire duration of your registration with the Application and for up to three (3) years after your last activity or the deletion of your account; the messages exchanged are retained for as long as the conversation has not been deleted by one of the users or the account closed; location data is retained only for the period strictly necessary for the proximity matching feature and is not kept as an extended location history.
11. Data security
We implement appropriate technical and organisational measures to protect your personal data against loss, misuse, unauthorised access, disclosure, alteration and destruction.
In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify it to the Commission nationale de l'informatique et des libertés (CNIL) within seventy-two (72) hours, in accordance with Article 33 of the GDPR, and will inform you directly where that breach is likely to result in a high risk to your rights and freedoms, in accordance with Article 34 of the GDPR.
12. Your rights
Under the GDPR, you have the following rights concerning your personal data:
  • Right of access: You have the right to request a copy of the personal data that we hold about you.
  • Right to erasure: You have the right to request the deletion of your personal data in certain circumstances.
  • Right to restriction of processing: You have the right to request the restriction of the processing of your data.
  • Right to data portability: You have the right to receive your personal data in a structured, commonly used and machine-readable format.
  • Right to object: You have the right to object to the processing of your personal data in certain circumstances.
  • Right to withdraw your consent: Where the processing is based on your consent, you may withdraw it at any time, without retroactive effect.
  • Right to human intervention: You have the right not to be subject to a fully automated decision producing legal effects concerning you, to obtain human intervention and to contest such a decision.
  • Right to lodge a complaint: You have the right to lodge a complaint with the Commission nationale de l'informatique et des libertés (CNIL), 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, or via www.cnil.fr, if you consider that the processing of your personal data constitutes a breach of the GDPR.

13. Protection of minors
The Application is not intended for persons under eighteen (18) years of age. We invite anyone who becomes aware of any use of the Application by a minor to contact us, so that we may proceed with the deletion of the account concerned.
14. Changes to this policy
We reserve the right to modify this privacy policy at any time. We will inform you of any modification by publishing the new policy on our application. We encourage you to consult this policy regularly in order to stay informed of our data protection practices.
In the event of a substantial modification affecting your rights, we will inform you by a specific notification within the Application, in addition to the publication of the new version.
