Whispers Application

The Whispers mobile application (hereinafter the "Application") is published and operated by Whispers (hereinafter "Whispers", "we").
By downloading, installing or using the Application, you agree to be bound by these terms of use ("Terms" or "Agreement").
Where you are a consumer within the meaning of the French Consumer Code, the provisions of this Agreement apply without prejudice to the rights mandatorily granted to you by law, in particular the provisions set out in Articles 2.2 to 2.4 below.
1. The basics
1.1 Acceptance of the terms
If you do not accept these terms, please do not use the Application.
1.2 Modification of the licence
Whispers reserves the right to cancel or modify the licences granted by this Agreement, as well as to replace all or part of the content or the features of the Application with an alternative. We will inform you of any substantial modification by a notification within the Application or by e-mail, with reasonable prior notice where the circumstances allow. If a substantial modification significantly reduces the features you subscribed to under a paid subscription, you may terminate your subscription under the conditions set out in Article 2.2, without penalty.
1.3 Intellectual property in the Application
The Application is protected by French copyright law and, where relevant, by the applicable international conventions. Whispers and its contributors reserve all rights that are not expressly granted to you under this licence, including all copyright and intellectual property rights attached to the Application itself.
1.4 Minimum age and minors
The Application is not intended for persons under eighteen (18) years of age. By using the Application, you represent and warrant that you are at least eighteen (18) years old.
1.5 User account
Creating an account is necessary in order to use the Application. You undertake to provide accurate and up-to-date information, and to keep your login credentials confidential. You are responsible for any activity carried out from your account, except for fraudulent use that could not be attributed to you. You may request the deletion of your account at any time; Whispers may also suspend or terminate an account in the event of a serious and established breach of this Agreement, in compliance with the principle of proportionality and with the rights of information and of challenge set out in Article 9.
2. Licence and subscription
Whispers grants you a limited, non-exclusive, non-transferable and revocable licence to use the Application on your mobile device, subject to compliance with these Terms.
The Application may be used free of charge, with advertising displayed. Users who wish to enjoy an advertising-free experience and premium features may take out the following subscription:
  • Monthly subscription: €4.99 per month
The subscription makes it possible in particular to remove advertising, to benefit from uncluttered conversations and from a smoother experience within the Application.
Subscriptions are renewed automatically, unless terminated by the user in accordance with the conditions of the download platform used (Apple App Store or Google Play Store).
2.1 Prices and billing
The prices indicated are expressed in euros, all taxes included. Payment is processed through the distribution platform used to download the Application (Apple's App Store or Google Play), according to the payment methods and billing arrangements specific to that platform.
2.2 Automatic renewal and termination
Unless terminated beforehand, the subscription is renewed automatically, for an equivalent duration, at the rate in force at the time of renewal, of which you will be informed in advance in the event of a change. In accordance with Law No. 2022-1158 of 16 August 2022 and its implementing decrees, you may terminate your subscription at any time, directly from the Application or from the settings of your App Store or Google Play account, by means of an online termination feature that is easily accessible in three clicks. Termination takes effect on the expiry of the current subscription period; unless otherwise provided by law, amounts already paid in respect of the current period are not refunded.
2.3 Right of withdrawal
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, where you are a consumer you have a period of fourteen (14) days from the date of subscription to exercise your right of withdrawal, without having to give any reason. However, if you expressly request to benefit from the subscription as from the moment you subscribe, before the expiry of that period, you acknowledge and accept, in accordance with Article L. 221-28 13° of the French Consumer Code, that your right of withdrawal ends as soon as performance of the service begins. In accordance with the obligation applicable to traders as from 19 June 2026, a direct and easily accessible online withdrawal feature is made available to you in the Application in order to allow you to exercise this right where it is applicable.
2.4 Legal guarantee of conformity
In your capacity as a consumer, you benefit from the legal guarantee of conformity applicable to digital services provided for in Articles L. 224-25-12 et seq. of the French Consumer Code, throughout the duration of the supply of the service and, at the very least, for a period of two (2) years from the supply for defects existing on that date. This guarantee may not be excluded or limited by this Agreement. In the event of a lack of conformity, you may request that the service be brought into conformity or, failing that, a reduction in the price, or the termination of the contract, under the conditions provided for by law.
3. Description of the Application
Whispers is a mobile application that allows users to discover and get in touch with people located nearby, according to three connection modes of their choice: Active (visible to other users), Blind Date (anonymous) and Shadow (private browsing).
4. Use of the Application
The Application allows you to make yourself visible to people nearby, to send and receive connection requests, and to exchange messages with other users. You undertake to use the Application solely for lawful purposes, in a respectful manner towards other users, and in accordance with the laws in force.
Whispers implements reasonable means to ensure the availability of the Application, without however guaranteeing uninterrupted access, in particular in the event of maintenance operations, updates or circumstances beyond its control.
5. Intellectual property
5.1 Whispers' intellectual property
All rights, title and interest relating to the Application, including all intellectual property rights, remain the exclusive property of Whispers. You must not reproduce, distribute, modify or create derivative works from the Application without the prior written authorisation of Whispers.
5.2 Licence over the content you share
"Content" means any element that you publish, share or transmit by means of the Application, in particular photographs and messages (hereinafter the "Content"). You retain full ownership of your Content.
In order to enable the operation, promotion and improvement of the Application, you grant Whispers a non-exclusive, royalty-free licence, within the limits of that purpose, for:
  • The right to reproduce all or part of the Content, in as many copies as it may wish, and to reproduce it on all media, known and unknown to date, solely for the purposes defined above;
  • The right to communicate all or part of the Content to the public, by all technical means and processes, known or as yet unknown to date, solely for the purposes defined above;
  • The right to adapt and modify all or part of the Content, solely to the extent necessary for the technical and editorial operation of the Application;
  • The right to make the Content available to the other users of the Application, as part of the matching features offered by Whispers.
This licence is granted for the duration of your registration with the Application and ends, subject to the copies already shared with other users and to the retention periods strictly necessary for legal, technical or evidentiary purposes, when you delete the Content concerned or your account. Whispers neither transfers nor commercialises your Content to third parties outside the operation of the Application, except with your express agreement.
6. Method for filtering objectionable content
The Application uses an automatic filtering method to detect and block objectionable content. This system is designed to identify inappropriate messages, images or behaviour in order to maintain a safe and respectful environment for all users.
Where this filtering is based on automated processing, you have the rights of information and, where applicable, of challenge set out in Article 9 below.
7. Reporting objectionable content
Users have the ability to report any objectionable content or behaviour through a mechanism built into the Application. To report content, please click the "Report" button associated with the profile, message or content in question and provide a brief description of the problem.
8. Blocking abusive users
The Application allows users to block other users deemed abusive. To block a user, go to their profile and select the "Block" option. Blocked users will no longer be able to locate you or to interact with you in the Application.
9. Whispers' actions on reports of objectionable content
Whispers undertakes to review any report of objectionable content within 24 hours. If the content is deemed inappropriate, a measure proportionate to the seriousness of the breach is applied, which may range from the removal of the content up to, in the event of a serious or repeated breach, the exclusion of the user who provided that content.
In accordance with Regulation (EU) 2022/2065 on digital services ("Digital Services Act"), any user affected by a decision to remove content or to suspend an account receives a statement of reasons for that decision and may challenge it by way of an internal complaint, under the conditions specified in the Application.
10. Limitation of liability
To the extent permitted by law, Whispers may not be held liable for indirect damages resulting from the use of or the inability to use the Application, nor for interactions or meetings between users taking place outside the Application.
This limitation does not apply in the event of gross negligence or wilful misconduct by Whispers, of personal injury, nor where it would have the effect of removing or reducing the right to compensation mandatorily granted to consumers by the French Consumer Code, in particular under the legal guarantee of conformity mentioned in Article 2.4. This clause does not call into question the legal guarantees from which you benefit in any event.
11. Changes to the Terms
Whispers reserves the right to modify these Terms at any time. Users will be informed of the changes through the Application or by e-mail. For users holding a paid subscription, any substantial change will be notified to you with reasonable prior notice and will apply only as from the following renewal, unless the change is required by law or is more favourable to you. Continued use of the Application after such changes come into force constitutes acceptance of the new terms.
12. Governing law and dispute resolution
This contract is governed by the laws in force in France. Where you are a consumer residing in another Member State of the European Union, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence.
Any dispute arising from this contract shall be submitted to the jurisdiction of the competent French judicial courts, except where you are a consumer, in which case you may also bring the matter before the court of the place where you resided at the time the contract was concluded or at the time the harmful event occurred, in accordance with the mandatory rules applicable to consumer disputes.
In accordance with Article L. 616-1 of the French Consumer Code, you have the right to have recourse free of charge to a consumer mediator in the event of a dispute that is not resolved directly with us. The contact details of the competent mediator will be provided to you on simple request to the contact indicated in Article 13.
